I recently appeared in the Constitutional Court, led by Jonathan Berger, on a matter related to whether SARS is empowered to waive interest under a Voluntary Disclosure Programme in terms of the Tax Administration Act subsequent to a valid Voluntary Disclosure Programme agreement. The taxpayer's request for the remission of interest was made in terms of s 39(7)(a) of the VAT Act.
In addition to the above, this matter gave me the opportunity to see a case through from start to finish, including two virtual appearances in the High Court, and in-person appearances in both the Supreme Court of Appeal, and the Constitutional Court. The case in question, Commissioner for the South African Revenue Service v Medtronic International Trading SARL, was argued on August 20, 2024. Judgment was reserved.
I have recently been brought in as a junior in a matter led by Rudolf Mastenbroek in an exchange control dispute dealing with regulation 22C against the South African Reserve Bank.
